Project and Hosting Specific Terms

These terms supplement our standard terms and conditions.

First American Web provides World Wide Web page hosting.

SERVER USE
Accounts are to be used by the primary owner only. Account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads, and personal ads.

First American Web reserves the right to refuse service and / or access to its servers to anyone.

First American Web does not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of First American Web.

Wares - Includes pirated software, ROMS, emulators, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

First American Web reserves the right to suspend or cancel a customer's access to any or all services provided by First American Web when First American Web decides that the account has been inappropriately used or otherwise.

UNLIMITED USE POLICY
High bandwidth usage: First American Web offers a high use policy by maintaining very large ratios of bandwidth per customer. In rare cases, First American Web may find a customer to be using server resources to such an extent that he or she may jeopardize server performance and resources for other customers. In such instances, First American Web reserves the right to impose the High Resource User Policy for the consideration of all customers.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization. First American Web may implement the following policy to its sole discretion:

When a website is found to be monopolizing the resources available First American Web reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby First American Web continues hosting the website for an additional fee.

DATA BACKUP
The customer is responsible for undertaking any data back up programs, database, web files or other digital material.

SPAM GUIDELINES
Unsolicited email (Spam) is considered an unacceptable use of a domain. Whether the unsolicited email originates directly from the clients web space area or otherwise, abuse reports received concerning a domain may result in suspension or closure of the service without refund.

PAYMENT POLICIES
All accounts are set up on a prepaid basis. Although First American Web reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each month following the date the account was established.

All renewal payments must be received at least 5 working days in advance of the renewal date to ensure that no disruption to the service is incurred. First American Web reserves the right to suspend this and other services until any outstanding debt is cleared. First American Web will not be responsible for any data lost due to non-payment closure of an account. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.

Reinstatement of an account is at First American Web's discretion. First American Web reserves the right to charge a reinstatement fee of 50 (fifty) dollars per account.

CANCELLATION AND REFUNDS
Fees charged on a prepaid basis are non-refundable.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold First American Web harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against First American Web, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless First American Web against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with First American Web' server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from First American Web's server.

DISCLAIMER
First American Web will not be responsible for any damages your business may suffer. First American Web makes no warranties of any kind, expressed or implied for services we provide. First American Web disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by First American Web and its employees. First American Web reserves the right to revise its policies at any time.

Package Specific Terms
Each pre-assembled package comes with a set number of items, pages, images, and other considerations that will be included at the advertised price. The breakdown is as follows:

For First American Web's SEO solution starting at $2,500 they will optimize the clients site for 8 search phrases of 3 to 4 words for 1 search engine. The expected success rate is of 25%.

Maintenance for the SEO package starts at only $79 per month. For highly competitive search phrases, more phrases or shorter search phrases, the prices will increase and we will provide a quotation.

The Pay Per Click Management service starting at $2,500 has a budget that is divided in two parts. $1,500 is invested in key word research (maximum of 450 search phrases) and setting up an account, listings (maximum 5 listings) and keywords in 1 PPC engine. Then $1,000 is used in a PPC budget, generally over the course of a month. This will determine the Cost Per Acquisition that the PPC Project can provide for the client. Maintenance starts at $89 per month in labor from First American Web, and it is at the client's discretion the amount of monthly PPC expenses. For larger projects; a custom setup and maintenance fee can be agreed upon in writing.

For the Affiliate Management Service starting at $3,500 First American Web will start a Client's affiliate program and recruit no less then 15 affiliates. They will provide affiliates with banners for the Client's web site, as well as handle all queries, negotiation and payments. The standard maintenance fee of $999 dollars a month, will cover FirstAmericanWeb.com handling up to $35,000 of affiliate payouts or 40 monthly payout transactions. Larger affiliate programs will be priced on a case-by-case basis.

The E-Commerce Solution Package starting at $6,000 will include the following:
A $1,800 E-commerce web design or re-design. A $2,500 SEO Package and a $2,500 PPC Package. The monthly maintenance for this plan is $160 per month.

Graphic design pricing is as follows:

Logo Design; The Basic Package (Price: $79)
First American Web will provide up to 2 designers who will work on the Customer's Logo. The designers will give the client up to 2 logo concepts and allow up to 2 revision rounds.

Logo Design: Premium Package (Price: $499)
First American Web will provide up to 4 designers, who will work on the Customer's logo. The designers will give the client up to 10 concepts and allow an unlimited number of revision rounds.

Brochure Design: The Basic Package (Price: $399)
First American Web will provide 1 designer who will work on the Customer's brochure. The designer will give the client 2 brochure concepts and allow up to 2 revision rounds. This is for a one-page brochure (2 sides).

Brochure Design: Premium Package (Price: $799)
First American Web will provide up to 2 designers, who will work on the Customer's brochure design. The designers will give the client up to 10 concepts and allow an unlimited number of revision rounds. This is for a 3-page brochure (6 sides).

Business Card Design: The Basic Package (Price: $99)
First American Web will provide 1 designer who will work on the Customer's business card. The designer will give the client 2 design concepts and allow up to 2 revision rounds. This price does not include any print work. Print work starts at an additional $59 for 100 cards on standard paper. Different prices are available for plastic and other materials.

Business Card Design: Premium Package (Price: $799)
First American Web will provide up to 2 designers, who will work on the Customer's business card design. The designers will give the client up to 4 concepts and allow an unlimited number of revision rounds. This package includes 100 business cards printed on First American Web's premium paper.

Banner Design: The Basic Package (Price: $39)
First American Web will provide 1 designer who will work on the Customer's Banners. The designer will give the client 2 banners and allow 1 revision round.

Banner Design: Premium Package (Price: $299)
First American Web will provide up to 2 designers who will work on the Customer's banners. The designers will give the client up to 10 banners and allow 2 revision rounds.

Additional Items

The price of additional items is below. Please note that these prices are subject to change if unusually elaborate requests are made:

* Additional Change after delivery being defined at our sole judgment as non-major changes. Major changes to the website will have greater costs which can be agreed upon on a case-by-case basis.

** Optional Maintenance fee is based on a $10 an hour web design cost. So a maintenance fee of $50 will allow 5 hours of monthly web design work. A maintenance fee of $15 will allow for one and a half hours of additional web design work per month.
